NEW MIGRATION LAW № 5275/6-2-2026

Law № 5275/2026 introduces a comprehensive reform of migration legislation in Greece. The regulatory changes aim to streamline procedures and transition them to an electronic format, strengthen the legal framework for legal migration, and significantly tighten measures against illegal stay in the country.


NEW MIGRATION LAW IN LAW

Limited Processing Time for Residence Permit Applications

Applications for the initial issuance or renewal of a residence permit must be processed by the competent authority within 90 days from the submission of a complete set of documents. In exceptional cases due to the complexity of the case, this period may be extended by a maximum of 30 additional days. In the event of such an extension, the applicant must be notified via the electronic system.


Minimum Validity Period of a Residence Permit

For all categories of residence permits issued or renewed for a period of at least three years, the law guarantees that the remaining validity of the residence permit after the authority’s decision will be no less than two years. If, at the time of issuance or renewal, the remaining validity is less than two years, it will be adjusted to meet the minimum period.


Late Submission of Residence Permit Applications

Under the new provisions, an application for the renewal of a residence permit may be submitted within three months after its expiration. An administrative fine of €100 is imposed for each month of late submission. After three months, applications are accepted only in the presence of documented exceptional circumstances.


Residence Permit for Children Under Six Years Old

The validity of a residence permit for minor children of third-country nationals under the age of six corresponds to the validity of the parent’s residence permit on whom they are dependent. Upon reaching the age of six, the child’s current residence permit expires, and a new residence permit must be obtained for continued stay, with mandatory biometric data submission in accordance with general rules.


Liability for Renting Property to Persons Illegally Residing in Greece

It is prohibited to rent property to third-country nationals who do not have a valid passport, visa, or residence permit. Violation of this prohibition carries an administrative fine ranging from €1,500 to €3,000.Persons who facilitate the illegal stay of individuals residing unlawfully in Greece or obstruct law enforcement actions are subject to criminal liability, including imprisonment for no less than two years and a fine of at least €5,000. If committed for financial gain, the minimum term of imprisonment increases to three years, and the fine rises to €10,000.


Stay of Students for Job Search

Foreign students holding a student residence permit, after completing their studies, are eligible to obtain a residence permit valid for one year for the purpose of job search or starting a business. Financial self-sufficiency, health insurance, and accommodation requirements remain in force; however, a national visa for entry is not required. A confirmation of successful completion of studies from the educational institution is mandatory. Renewal of this residence permit is permitted if the individual obtains employment or commences a business activity.


New “Second Chance” Residence Permit Category

A new residence permit category has been introduced for third-country nationals who legally resided in Greece for at least five years but lost their permit due to expiration, refusal of renewal, or annulment. Eligibility requires continuous residence in the country, no absences exceeding six months, and no threat to public order or security.
